1. Agreement
These Terms of Service (“Terms”) govern your use of Hypecut, including this website, the dashboard and related services (the “Service”), provided by VinciX LLC, a Virginia limited liability company (“VinciX”, “we”, “us”). By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you don’t agree, don’t use the Service.
2. Eligibility
You must be at least 13 years old (or older where local law requires) and allowed to use Twitch and TikTok under their terms. If you’re under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian, who agrees to these Terms on your behalf.
3. Your account
- You need an account, created with an email address you control and a password.
- Keep your password confidential. You’re responsible for activity under your account. Tell us promptly at info@vincix.ai if you suspect unauthorized use.
- Don’t share your account or create accounts by automated means.
- You can delete your account at any time under Dashboard → Settings → Delete account.
4. The service
Hypecut is an AI-assisted tool that helps livestreamers turn moments from a broadcast into short videos while the stream is still live. It watches the chat of Twitch channels you add, detects the moments chat reacts to (from chat’s pace, reactions and spikes above the channel’s usual activity), creates Twitch clips of them, uses AI to edit each clip into a 9:16 vertical video with on-screen text, a caption and hashtags, and puts it in your dashboard for your review. If you connect TikTok, you can send the videos you approve to your TikTok drafts.
The AI finds and prepares moments; you decide what’s shared. Hypecut never publishes a video on TikTok for you (see section 6).
Hypecut is an early-stage product. We may add, change or remove features. Hypecut won’t catch every moment, may clip moments you don’t want, and depends on Twitch and TikTok being available, so we don’t guarantee that it will work without interruption or error.
Plans, credits and payment
- Credits. One credit makes one video: the AI-edited vertical cut of a clip. Changing a video’s text or framing doesn’t use a credit, and neither does a cut that fails. When you have no credits, Hypecut keeps finding and clipping moments, and their videos wait until you have credits again. Credits have no cash value and can’t be transferred or exchanged.
- Free credits. A new account gets the free credits shown on our pricing page, once. They don’t expire while your account exists.
- Plans. A paid plan is a monthly subscription, charged in advance, that renews automatically each month until you cancel. Each renewal gives you the plan’s monthly credits; unused monthly credits don’t carry over. The price, credits and channels of each plan are shown on our pricing page and at checkout.
- Packs. A credit pack is a one-off purchase. Its credits don’t expire while your account exists, and they’re used after your plan’s monthly credits.
- Changing plans. An upgrade starts right away: you’re charged the prorated difference and get the new plan’s monthly credits minus those you’ve already used this period. A downgrade starts at your next renewal.
- Cancelling. You can cancel at any time in Settings. Your plan continues until the end of the period you’ve paid for, then your account moves to the free plan, and channels beyond its limit are paused. Deleting your account cancels your plan, and any unused credits are lost.
- Payment. Stripe processes payments; we never see or store your card number. Prices are in US dollars and don’t include taxes that may apply, which you’re responsible for. If a renewal payment fails, we may pause your plan until it’s paid.
- Refunds. Payments are non-refundable, except where the law requires otherwise or we decide to make an exception. Contact info@vincix.ai if something went wrong.
- Price changes. We’ll email you at least 30 days before a new price applies to your plan. If you don’t want to continue at the new price, cancel before it takes effect.
5. Twitch channels and clips
- Only add channels you own or are authorized to manage. Hypecut is for making new videos from livestreams you own or are authorized to use. Don’t use it to clip or repost other creators’ streams without their permission.
- By adding a channel, you authorize us to read its public chat, create clips of it through Twitch’s API, and download and edit those clips into videos for you.
- Twitch clips are hosted by Twitch and are publicly viewable there. If you connect your Twitch account, Hypecut creates clips with it, so they’re attributed to you; otherwise they may be attributed to the Twitch account Hypecut uses to create them. Clipping depends on the channel’s clip settings. As the broadcaster, you can delete clips of your channel in Twitch’s Clips Manager.
- You’re responsible for complying with Twitch’s Terms of Service and Community Guidelines for your channel.
- The dashboard’s live view uses Twitch’s embedded player and chat, which Twitch provides under its own terms.
6. TikTok
- Connecting TikTok is optional. It lets you send videos to your TikTok inbox through TikTok’s Content Posting API: you preview a video in the dashboard, edit its text, framing and caption, approve it, and click “Send to TikTok drafts”. Each click sends that one video. The AI finding a moment never sends it to TikTok by itself.
- We never publish for you. Every video arrives as a draft, and nothing appears on your TikTok profile until you finish and publish it yourself in the TikTok app.
- We only send videos Hypecut made from the channels you added. Hypecut doesn’t take, scrape or repost anyone else’s videos.
- With “Learn from my TikTok” on, we also read your posted videos’ captions, covers and stats to learn how you write hooks and captions. You can turn it off in Settings.
- You’re responsible for what you publish on TikTok and for complying with TikTok’s Terms of Service and Community Guidelines.
- TikTok sets its own limits, such as a cap on how many drafts can wait in your inbox within 24 hours, and can change or end its API at any time. Hypecut follows these limits: when TikTok refuses an upload for one of them, we show you why and don’t retry it on our own.
- You can disconnect TikTok in the dashboard’s Settings at any time.
Hypecut is not affiliated with, endorsed or sponsored by TikTok or Twitch. TikTok and Twitch are trademarks of their owners.
7. AI features
Hypecut uses third-party AI (currently Anthropic’s Claude models) to pick each video’s cut and layout and to write its hook, caption and hashtags (in your own style, if you let it learn from your TikTok), as described in our Privacy Policy. AI output can be inaccurate, off-tone or inappropriate, and it’s based partly on chat messages written by strangers. Review every video and its copy before you approve it or send it to TikTok. You’re responsible for what you approve and publish.
8. Your content
“Your Content” means your stream, clips, the videos Hypecut makes from them, and the hooks, captions and hashtags you approve or write. You keep ownership of Your Content.
You grant VinciX a worldwide, non-exclusive, royalty-free license to host, store, copy, edit (including cutting, cropping and adding text), process and transmit Your Content only as needed to provide the Service to you, including sending it to our service providers and to TikTok at your direction. This license ends when you delete Your Content or your account, except for copies in backups for a limited period, as described in the Privacy Policy.
You confirm that you have the rights needed for Hypecut to make and post videos from your streams, including rights to any music, game footage, video or people that appear in them. Chat messages belong to the people who wrote them; please treat them with respect.
9. Acceptable use
You agree not to:
- use the Service for anything illegal or that infringes anyone’s rights;
- add channels you aren’t authorized to manage, or harvest chat data for any other purpose;
- use the Service to download, scrape or redistribute videos or streams you don’t own or aren’t authorized to use;
- use the Service to harass, expose or target chatters or anyone else;
- try to access other users’ data, probe or bypass the Service’s security, or interfere with or overload it;
- use the AI features to produce harmful, illegal or abusive content, or in violation of Anthropic’s Usage Policy;
- reverse engineer the Service, except where the law expressly allows it; or
- resell, sublicense or commercially exploit the Service itself.
10. Copyright complaints
If you believe content processed through Hypecut infringes your copyright, email info@vincix.ai with a description of the work, where the content is, your contact details, and a statement that you have a good-faith belief the use isn’t authorized. We’ll respond promptly, and we may disable accounts of repeat infringers.
11. Third-party services
The Service relies on services run by others, including Twitch, TikTok, Anthropic, Supabase, Vercel, Resend, Railway and Stripe. Your use of your Twitch and TikTok accounts is governed by their own terms and privacy policies. We aren’t responsible for third-party services, and features that depend on them may change if they do.
12. Our intellectual property
The Service, including its software, design, text and the Hypecut name and logo, belongs to VinciX and its licensors. Subject to these Terms, we give you a limited, non-exclusive, non-transferable, revocable license to use the Service. If you send us feedback or ideas, we may use them without restriction or payment to you.
13. Termination
You can stop using the Service and delete your account at any time. We may suspend or end your access if you materially or repeatedly breach these Terms, if the law requires it, or if we discontinue the Service. Where reasonable, we’ll give you notice first. When your account ends, we delete your data as described in the Privacy Policy. Sections 8 and 12 through 19 survive termination.
14. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don’t warrant that the Service will be uninterrupted, secure or error-free, that it will detect any particular moment, that AI output will be accurate or appropriate, or that any video will perform well on TikTok.
15. Limitation of liability
To the fullest extent permitted by law, VinciX and its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, followers, goodwill or opportunities, arising out of or related to your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim or US $50.
Some jurisdictions don’t allow certain exclusions or limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that can’t be limited by law, or your rights under the mandatory consumer laws of your country.
16. Indemnification
To the extent permitted by law, you agree to indemnify and hold VinciX harmless from claims, damages and expenses (including reasonable legal fees) arising from Your Content, the channels you add, what you publish, or your breach of these Terms or applicable law.
17. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. Before filing a claim, you agree to contact us at info@vincix.ai and try to resolve the dispute informally for at least 30 days. Disputes that aren’t resolved informally will be brought only in the state or federal courts located in Virginia, and you and VinciX consent to their jurisdiction. If you’re a consumer living outside the United States, you may also be able to bring proceedings in your country and keep the protection of its mandatory consumer laws.
18. Changes to these Terms
We may update these Terms. We’ll change the “Last updated” date, and for material changes we’ll give you reasonable notice in the dashboard or by email before they take effect. If you keep using the Service after that, you accept the updated Terms. If you don’t agree, stop using the Service and delete your account.
19. General
- These Terms and the Privacy Policy are the entire agreement between you and VinciX about the Service.
- If any provision is unenforceable, the rest stays in effect.
- Not enforcing a provision isn’t a waiver of our right to do so later.
- You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
- We’re not liable for delays or failures caused by events beyond our reasonable control.
